These terms govern purchases of products and services through SpearesMedical.com. “Speares Medical,” “we,” “us,” and “our” refer to Speares Medical. “You” and “your” refer to the customer.
By placing an order, you agree to these terms unless a separate signed purchase agreement with Speares Medical or an affiliated company applies.
Orders & Agreements
The terms posted when you place or modify an order govern that order. We may update these terms for future orders without prior notice.
These terms constitute the entire agreement regarding website purchases unless a separate signed agreement governs. Any modification or termination of an existing purchase agreement must be approved in writing and signed by TransMed Company, LLC.
Product Use & Screening Results
Our drug screening products provide preliminary, qualitative results. For a more specific result, we recommend confirmation by gas chromatography/mass spectrometry (GC/MS) through a SAMHSA-certified laboratory.
Follow the manufacturer’s instructions for product storage, use, and interpretation of results.
Pricing & Website Information
Prices, products, descriptions, and offers may change without notice due to market conditions, manufacturer price changes, product discontinuation, advertising errors, or other circumstances.
We strive to provide accurate website information but do not guarantee that all content is complete, accurate, or current.

Payment Terms
Unless an invoice specifies otherwise, payment is required in advance. Payment must be received by the applicable due date.
These terms and the seller’s invoice take precedence over conflicting terms in a customer’s purchase order, unless a separate signed agreement provides otherwise.
Delinquent accounts are subject to a collection agency fee equal to 20% of the outstanding balance, to the extent permitted by applicable law.
Shipping Responsibility & Returns
Speares Medical is responsible for loss or damage during shipment when we select the carrier. If you select the carrier, you are responsible for loss or damage during shipment.

Disclaimer of Warranties
To the fullest extent permitted by applicable law, Speares Medical disclaims express and implied warranties, including implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
To the fullest extent permitted by applicable law, Speares Medical will not be liable for indirect, special, punitive, or consequential damages, including lost profits or business, even if advised of the possibility of such damages. This limitation also applies to third-party claims, except as expressly provided in these terms.
Speares Medical will not be liable for products or services being unavailable for use.
For claims relating to purchased products or services, the total liability of Speares Medical and TransMed Company, LLC will not exceed the aggregate amount you paid for the purchases under the applicable agreement.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
Governing Law & Disputes
These terms and related sales are governed by Georgia law, without regard to conflict-of-law rules. You consent to jurisdiction in the state or federal courts serving Forsyth County, Georgia, for disputes arising from these terms.
